Terms of service
What we provide
Local marketing services for small service businesses, as described on the pricing page for the plan you choose: a custom jingle; management of your Google Business Profile; a weekly podcast episode and blog post produced from material you give us; one or more landing pages on a website you own; and, on Presence + Phone, management of YouTube video advertising in your own Google Ads account, a call-tracking number, and missed-call text-back. Plans are month to month. Details of each plan may change; we tell active clients by email at least 30 days before any change that reduces what they get.
What we need from you
Manager access (not ownership) to your Google Business Profile and Google Ads account; a list of the problems your business solves and a short recording session at the start; written consent to clone your voice for your own content; job photos from time to time; prompt answers when a customer reviews you and we ask how to reply; and a working phone that someone answers. If we cannot reach you for 30 days we pause work and billing until we can.
Your voice and your likeness
We create a clone of your voice only after you sign a consent form, and we use it only to produce content published under your business name. You may withdraw consent at any time; see the privacy page. You confirm that the voice we clone is your own and that you have the right to license it for this purpose.
Ownership
You own your Google accounts, your website and its content, your podcast feed and episodes, and your recordings. On payment of your first month, or of the jingle fee, we assign to you all rights we hold in the jingle and in content we produce for you. Music generated with the help of AI tools may not qualify for copyright protection under current US law; we do not promise that no one can ever copy it. What we do promise is in the next section.
One seat per trade, per town
While you are an active client we will not take on another business in your trade in the town or service area named in your onboarding form. If you cancel, the seat opens after your final paid month ends. This is a contractual promise from us to you, not a trademark, and it is our only exclusivity commitment.
Promises on your pages
Landing pages we build may carry a headline guarantee such as a leak-free promise or a first-visit promise, with written terms. You choose the promise and its terms, and you are responsible for honoring it with your customers. We will not publish a guarantee you have not approved in writing.
Reviews and platform rules
We request reviews only from real customers, with neutral wording and no incentive, and we reply to reviews in your name. We follow Google's content and advertising policies and ask you to do the same. We will not post fake reviews, buy reviews, or run ads that violate Google's rules, and we may end service if asked to.
Ad spend
Advertising costs are paid by you to Google from your own account and are separate from our fee. We set daily budgets you approve and do not exceed them without your written agreement.
Payment
Fees are billed in advance each month through Stripe. Failed payments pause service after seven days. Prices are in US dollars and exclude any taxes that apply. Refund and cancellation terms are on the refunds page and form part of these terms.
Results
We report what we measure and we work to raise it. We do not guarantee a number of calls, leads, jobs, rankings or revenue. Marketing results depend on your market, your prices, and how you answer the phone.
Confidentiality
We keep your business information private and use it only to serve you. You agree not to share our internal methods, pricing offers or reports with competitors.
Limits on liability
Our total liability to you for anything arising from these terms is limited to the fees you paid us in the three months before the claim. We are not liable for lost profits or indirect losses, or for the acts of third-party platforms such as Google, YouTube, Apple or Spotify. Nothing here limits liability that cannot be limited by law.
Ending service
Either of us can end a monthly plan at any time as described on the refunds page. We may end service immediately if you ask us to break a platform rule or a law, or if payment fails and is not cured within 14 days.
Law and disputes
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Before either of us files a claim we agree to talk it through in good faith for 30 days. Any claim not resolved that way goes to the state or federal courts in Delaware, or to small-claims court where you are, at the claimant's choice.
